Punishment for the Alabama Teabagger

After the NCAA football championship last year, an Alabama fan took his junk out, rubbed it on a passed-out LSU fan's face, and then pretend fucked him with his still-out weener. It was caught on video, of course--and now they've found and arrested the guy.

Disgust aside... what do you think he's guilty of? What is the appropriate punishment?

Personally... I don't know what to think. What he did is vile, illegal, and deserves to be punished... but it seems like they're going "sex crime" with the charges, and I'm not sure I agree with that.

If I were prosecuting, I'd shoot for 1st or 2nd Degree Sexual Abuse, leaning towards 1st Degree Sexual Abuse because his victim was incapacitated.

He being 19 years old or older, subjects another person to sexual contact who is less than 16 years old, but more than 12 years old.

In what way is this not a sex crime?  It's kind of obvious that this was a public attempt to use sexual contact to humiliate somebody, and it seems open and shut that the 1st Degree Sexual Abuse definition fits the case perfectly.
