Oatmeal/Funnyjunk thing has me thinking

OK, so from what I can see of the internet, and this includes my internet boyfriend Wil Wheaton, here is the situation:
Funnyjunk stealing Oatmeal's stuff: Doubleplus ungood. Ur mom humps bearz!
BUT...
Piratebay stealing "Hollywood's" stuff: Why so mad? DRM suxx!
The key difference seems to be the attribution. So, if all you care about is proper attribution then this is a simple "case closed" issue.
But why is attribution all that matters? Just because it's all that matters to you doesn't mean it's all that matters to anyone. Maybe Lars just wants his $$$, and fuck the attribution.
Anyway, I still don't really know where to go with this, but I've been thinking about it.

Actually, I think for the pro-piracy types in this case this is actually where the difference comes in.
For common piracy, eg music or movies, the pirates are taking something that is required to be paid for and making it available for free. In theory, the theory is along the lines of an "information should be free" free-love hippy thing.
In this case though, The Oatmeal already puts its stuff up for free. What is happening here is that somebody else is taking a freely available product and putting it up where they can make money off of it.

You're also missing the point. The Oatmeal didn't use DMCA and send a takedown order. He just called them douchebags for taking his content and SELLING advertisements when people looked at it.
Now, the problem is that Funnyjunk is pissed because The Oatmeal has left the douchbag post up, EVEN AFTER they took down the ones he complained about.
Then the lawyer sends him a douchy letter and he (oatmeal) posts the hilarious mom seducing a bear post and the lawyer went batshit insane with a lawsuit against everyone.

My big question is how the reasonably small difference, a difference in degree but not really in nature, between what Piratebay and Funnyjunk do is this obvious and universal line of douchebaggery, with a grand consensus that this is *precisely* where the line is that "good" people shall not cross.
Piratebay (as a representative in this argument for all file sharing) == good, Funnyjunk == bad. This is immediately obvious to everyone, or at least a large consensus.
The lawyer part is a different topic (he's the king of assholes, obviously, and there is probably literally* not a single person in the world who would agree with his points).
*Actually using the word "literally" properly here.

Perhaps if you described where youre getting the impression that people actually think that...
All Im aware of are the people like Belg posted, who hate FunnyJunk because of the current legal stuff, or people like I posted about, who hate FunnyJunk because they take advantage of content that is already freely available instead of making paid content freely available. The only other category Im aware of is people who just hate it because they feel that funnyjunk users are douches/trolls, rather than anything to do with the hosted content.
If there are people who love piratebay but hate funnyjunk who fall outside those categories, I havent been exposed to them to have any clue why they feel that way.
