How does copyright and "death + 70 years" work out for works published after the author died?

So, for the first season at least, it's supposed to be following young Aragorn? I suppose that makes sense as a kind of wide net to attract maximum viewership for s1, but I was really hoping they'd take a deep cut and go Silmarillion.

Can't.

Tolkien himself sold the film rights to the 4 main books.  But he didn't expect to ever publish the Silmarillion (or other similar materials), let alone have someone want the film rights.  And the estate has been very very very anti-film for every scrap of material that wasn't already sold in the 50s.

Suffice to say there is plenty of material in the appendices of the main book to form the framework for a very interesting and engaging story about young Aragorn.  BUT it is only a barebones outline.  Plenty of "a decade in one sentence" instances.  There will be a large amount of whole-cloth creation to fill in the story from an outline level to a narrative level.  And some people will not be satisfied no matter what sort of whole-cloth creation is done.
